Representative Green objected. Representative Brown moved and asked unanimous consent that she be allowed to abstain from voting due to a conflict of interest. Objection was heard, and Representative Brown was required to vote. Representative Brown moved and asked unanimous consent to withdraw Amendment No. 1. There being no objection, it was so ordered. Amendment No. 2 was offered by Representative Brown: Page 3, line 29, following "occupancy": Insert: "and a person exempted under this paragraph, notwithstanding that exemption, is subject to the board to the extent that the board may investigate and administratively adjudicate under AS44.62 (Administrative Procedure Act) a complaint that the person engaged in fraud, deceit, gross negligence, incompetence, or misconduct in the practice of engineering under this exemption, and if the board determines that the person engaged in the conduct, the person may not claim this exemption for work involving the practice of engineering performed after the board's determination, unless the board's determination is reversed on appeal taken by the person under AS44.62" Representative Brown moved and asked unanimous consent that Amendment No. 2 be adopted. The Speaker stated that, without objection, CSHB 46(STA) would be moved to the bottom of the calendar.
